MANKATO — Minnesota State University football coach Todd Hoffner was charged Wednesday with use of minors in a sexual performance and possession of child pornography.
According to the complaint, an MSU official provided Mankato police with a compact disc containing three videos of child pornography involving Hoffner's children that were of varying lengths.
The videos had been obtained from Hoffner's university- issued cell phone. Mankato police were notified of the vidoes and turned the investigation over to the Blue Earth County Sheriffs Department, who handle cases for Eagle Lake, where Hoffner lives.
The sheriffs investigators determined three videos produced in June and August show three children under 10 years old taking off towels they were wearing and dancing around in some cases fondling themselves and exposing parts of their buttocks. As they were filmed, and adult voice could be heard.
The children called the adult "dad" in the video and investigators determined through photos and facebook that the children in the video were Hoffner's children.
In a brief statement to reporters, Hoffner's attorney, James Fleming, said there's nothing pornographic about the videos Hoffner took. He said they were "private family moments that were videotaped. There's nothing in there that's graphic or sexually exploitive or anything along those lines."
Another video shows a young girl sleeping and then being asked by an adult to go to the bathroom. The video show her buttocks with underwear on as she is walking to the bathroom.
The videos were obtained by university IT people when they were attempting to fix Hoffner's phone. They were then turned over to investigators.
Hoffner is being represented by Jim Fleming, a onetime chief public defender but now in private practice.
Hoffner's bail was set at $40,000 without conditions and $10,000 with conditions. One of the conditions is that he can only be with his children if another adult is present.
