Vehicular homicide charges filed for February crash

Investigators suspect driver was speeding, had been drinking

— A 35-year-old Fairfax man is facing felony charges in Le Sueur County for allegedly driving recklessly with alcohol in his system when he crashed his car into a tree and killed a 21-year-old passenger.

Two counts of felony criminal vehicular operation and two counts of gross misdemeanor criminal vehicular homicide  were filed today against Coy Charles Hewitt, 35, of Fairfax. He is scheduled to make his first court appearance on July 10.

Hewitt was driving a 2009 Dodge Avenger on Le Sueur County Road 45, also known as the Rabbit Road, when he lost countrol in a curve, left the roadway and crashed into a tree, a Le Sueur County Sheriff's Department report said. Investigators determined Hewitt had a blood-alcohol concentration of .04, which is within the legal limit of .08 for driving, and driving over the speed limit.

A passenger, Elizabeth Risk, 21 was killed.

Both alcohol and speed were determined to be factors in the crash. Three other passengers in the car were injured.
